In a recent development, the Principal District & Sessions Judge (West), Delhi, has ordered a stay on proceedings pending before the Court of the Judicial Magistrate First Class (JMFC-01) at Tis Hazari Courts. The decision was taken after the court heard doubts about the fairness of the proceedings. The allegations were, the legal system was being used to harass and pressurize certain people.
The applicants went to the Court wanting the transfer of various cases. Those cases had been filed by or on behalf of Vikas Garg and people related to him. According to them, the way these cases were handled were not fair.
During the hearing, the applicants alleged Vikas Garg that he has constantly used legal proceedings as a way of creating pressure on individuals and organisations. In support of their argument they talked about orders that were passed in other cases. In those cases, allegations were made against investor inducement, intimidation, and misuse of legal procedures.
The applicants have also pointed to complaints where financial documents of third parties were brought without any direct connection. According to the applicants this move meant the criminal justice system was being used for illegitimate reasons.
Another issue was raised before the Court. That issue was how frequently matters regarding Vikas Garg and related parties were listed before the same Trial Court. The applicants argued this pattern created distress. The course of action could possibly influence normal procedure of justice.
The Principal District Court found these allegations serious enough and they issue warrant for further examination. The Principal Court also sought comments from the Presiding Officer in a sealed cover. Most importantly the Court said that all proceedings before the Trial Court should be stayed until the transfer petitions are considered further.
The stay order is being seen as an important development because it portrays that the District Court believes these raised issues are serious enough and further scrutiny or examination is needed before the case can move forward.
According to the applicants, the interim relief granted by the court has brought attention to a longstanding issue. The case was alleged misuse of legal processes by Vikas Garg and his associates. They maintain that the stay order is an important safeguard that can possibly change judicial proceedings and make it fair, unbiased.
The matter is now scheduled before the Principal District & Sessions Judge (West) on 31 July 2026. The applicants have confidence that the judicial process will make sure that all proceedings will be conducted fairly.
